Just before midnight, a vehicle was called in from the Duchesne bar for a disorderly male. Deputy Cox observed the same vehicle traveling Southeast on Starvation Lake Road towards US 40 in Duchesne City.
When the vehicle turned left to go East on Main Street, the driver failed to signal. The driver then continued East and increased speed in the 40 mph zone, which was confirmed on the deputy’s radar, which had a steady tone and showed the vehicle's speed at 48 mph.
The driver drifted over the white line from the inside lane and outside lane. Deputy Cox activated my emergency lights and initiated a traffic stop at 50 North 400 West.
Deputy Cox approached the vehicle and requested a driver's license. The driver refused and wanted to know why he was stopped. The driver had a strong odor of alcohol coming from his breath, and his eyes were red and watery.
The driver stated that he is also an officer, which is not true, and provided his driver's license, identifying him as 64-year-old Clint Al Ivie.
Deputy Cox asked Clint if he had been drinking, and answered that he had not been. The deputy advised him that he could detect the strong odor of alcohol and then asked him to exit the vehicle to perform standard field sobriety tasks (SFSTs).
Prior to beginning those tasks, Deputy Cox asked Clint if he had any medical or physical problems. Clint claimed several medical issues from being in war and that he has been shot and died 5 times.
Based on the deputy's observations, he determined that Clint was under the influence while impaired and in actual physical control of a motor vehicle.
Clint Ivie was placed under arrest for DUI and searched before being placed in the back of the patrol vehicle. Deputy Cox found a green leafy plant material consistent with marijuana. Clint continued to be argumentative.
Deputy Cox read the driver's license admonitions and requested a blood test. Clint refused. He then read the refusal warning, and Clint said, "No comment."
A search warrant was submitted for two vials of blood to be taken from Clint’s body. A Judge approved the warrant, and a nurse at the hospital successfully drew two vials of blood from Clint. Clint received a medical clearance while at the hospital.
Clint continued to be loud and would yell from his room. The deputy told Clint to stop because other patients and children in the other rooms could hear him, but he refused to be quiet.
Prior to leaving the hospital, medical staff were going to remove the needles from Clint's arms, but he became more disorderly and pulled away, yelling that he was going to rip them out. Clint had to be physically restrained so medical staff could do their job.
He was then booked into the Duchesne County Jail for driving under the influence 2nd offense as he has a prior conviction from 2021, possession of controlled substance marijuana, possession of drug paraphernalia for the baggy used to contain the marijuana, failure to signal and speeding and disorderly conduct after request to cease.
