A day of fun turns to violence when a man wants to play Russian roulette and shoots a hole in the floor

On Saturday December 21st, Uintah County Deputies along with a Vernal City Police officer were dispatched to an unknown 911 call where the caller whispered on the phone she needed help.


While police were en route, dispatch advised they could hear people in the background arguing, and the male subject had a firearm and discharged the gun inside the residence.


When Deputy Oldham arrived, several other deputies were on scene and had the male subject in the back of a patrol vehicle, and an officer was speaking with the victim, who was also in handcuffs next to a patrol vehicle.


Two deputies entered the residence, where they spoke with a witness who explained that she and her boyfriend were spending the night with the victim and her boyfriend, 25-year-old Dylon Ray Smuin.


The witness was cooking early that morning and throughout the night, where they were consuming alcohol. She stated that she and the victim were near the stove, and Dylon was sitting at the dining room table playing with the firearm. Dylon made the comment of wanting to play Russian roulette, and that's when the gun discharged into the kitchen floor.


The witness then said Dylon locked the firearm inside the gun safe cabinet. The victim then confronted Dylon, expressing that he needed to get out of her house. The argument continued into the living room, where the victim was holding Dylon's stereo. She dropped the stereo when Dylon shoved her to the floor, causing her to hit her head.


The witness’s boyfriend heard the gun go off and ran into the children’s bedroom to check on them before entering the living room. He stated that when he entered, he found Dylon and the victim yelling at each other.


Deputy Anderton remained inside the residence looking for the bullet hole, which was discovered near the dining room table in the floor. There were also five live .22 caliber rounds sitting on the table.


Deputy Oldham learned from Deputy Roth that when he and Deputy Anderton arrived, Dylon answered the door, but once he saw it was law enforcement, he said, "Nope," and proceeded to shut the door.


Deputy Roth and Anderton then made entry, where they had to go hands-on with Dylon in the doorway, taking him to the ground due to his resistance. It was also explained that the witness then had to hold the victim back from interfering with the deputies. Officer Maughan arrived, placed the victim in handcuffs, and detained her during the duration of the investigation.


At this time, Officer Maughan called for an ambulance due to the victim passing out. Deputy Oldham returned to his vehicle and found the victim removed from the vehicle and lying on the ground in the recovery position. The witness told Deputy Oldham during the night, she had to give the victim her medication for seizures twice.


Later, Sgt. Cheshire went to the hospital but was informed that the victim was currently sleeping and was unable to speak with her.


Deputies read Dylon his Miranda Rights and questioned him about the firearm. He was willing to show them where the bullet hole was and also gave them consent to enter the gun safe to retrieve the gun.


Dylon stated that he was emptying the firearm and miscounted, and that is when he shot the floor, almost hitting his foot.


Dylon Ray Smuin may post bail in the amount of $4,070.00.
