A 64-year-old man in Jensen arrested with drugs during an investigation regarding a protective order violation

Deputy Fairey was conducting a follow-up investigation regarding a protective order violation in Jensen.
The night before, a Vernal City Police Officer informed the deputy he encountered 64-year-old Brian Paul Fitzwater in Jensen while serving papers.
Upon further investigation, it was discovered that Brian had an active protective order prohibiting him from being at that location. The petitioner was also present at the time.
Deputy Fairey researched and confirmed that the protective order that Brian had been served with in 2023 had no revisions or modifications. The order explicitly says that Brian was not allowed at the Jensen address and was prohibited from contacting or being around the protected parties.
The deputy drove to the residence and saw Brian Fitzwater in the backyard. When Deputy Fairley began walking toward the suspect, believed to be Brian, who was holding a garden hose, he became confrontational, refusing to turn off the water from the hose.
Brian took an aggressive stance and appeared ready to fight, resist, or possibly spray the deputy with the hose. After multiple commands and being ordered at taser point, Brian eventually complied and got on his knees.
While Brian was getting on his knees, he threw something small and black away from him. Once he was detained and secured in the back of the patrol vehicle, Deputy Fairley returned to the backyard to collect evidence.
In the area where Brian had thrown the black item, the deputy found a black pouch containing a glass pipe used for methamphetamine. Among the items Brian had placed on the ground was an electronic vape with an orange cartridge marked "THC."
Brian denied throwing the black pouch and claimed not to know what it was. When questioned about the THC vape, he claimed to have a medical marijuana card, but a check with dispatch revealed that Brian's card expired in 2021.
A criminal history showed an extensive history of drug involvement, though no convictions within the past seven years.
Brian Fitzwater was booked into jail on charges of violation of a protective order, possession of methamphetamine, possession of marijuana, possession of drug paraphernalia, and obstruction of justice.
Brian Paul Fitzwater is being held without bail.
